Petaluma Motorcycle Crackdown - 51 Traffic Tickets Issued

On November 14, 2011, the Petaluma Police Department ran an all day traffic enforcement targeting motorcycle safety. In the end 51 traffic tickets were issued but only one to a motorcyclist.

Among the citations issued by the Petaluma Police Officers were tickets for speeding, cellphone use, illegal U-turns, passing over double yellow lines, running red lights and a pedestrian obstructing traffic. In addition, officers made two arrests, one for drunk driving and one for possession of a controlled substance. The driver arrested for drug possession had been stopped for a cellphone violation and officers allegedly smelled marijuana before conducting a further investigation.

The 4th Amendment to the United States Constitution protects us all from unreasonable and warrantless searches and seizures. That protection extends to traffic stops. Police in California can stop a vehicle based on a reasonable belief that a vehicle code violation has occurred and traffic stops are routinely initiated for lighting and mechanical violations as well as for speeding, cell phone usage, illegal turning movements and failure to stop. For an officer to conduct a search of a person or her vehicle without a warrant there must be probable cause to believe a crime has been committed or the officer must have received valid consent from the driver prior to conducting the search.

Santa Rosa DUI arrest after driver flips car

Jason Douglas Hopkins, 32, of Santa Rosa, was arrested on suspicion of DUI on Tuesday after driving into a ditch and flipping the PT Cruiser he was driving.

Mr. Hopkins sustained minor injuries in the crash and was treated at Santa Rosa Memorial Hospital. The hospital reported that suspected marijuana and/or hashish was found in his belongings.

In addition to suspicion of DUI, CHP officers arrested Mr Hopkins for driving with a suspended license and possession of concentrated cannabis.

San Francisco Police Officer dragged by suspected DUI Driver

Early Friday morning, October 23, 2009, a San Francisco Police Officer contacted Antonio Dalballo after stopping him for a traffic violation in the Haight Ashbury neighborhood. When the officer approached Mr. Dalballo he smelled the order of an alcoholic beverage and began a DUI investigation.

When the officer ordered Mr. Dalballo to exit his vehicle he ignored the officer's commands and began to reach for his ignition. When the officer reached for the car keys Mr. Dalballo grabbed the officer's arm and took off speeding and colliding with several cars while dragging the officer.

The officer was eventually thrown to the ground and Mr. Dalballo was arrested a short time later. He was booked on suspicion of felony aggravated assault on an officer, felony drunken driving with injury, evading a police officer and marijuana possession.
